Service Agreement & Liability Waiver
1. Scope of Service
Co-CIO Drive Recovery ("Provider") performs software-based data recovery only. We do not open drive enclosures, replace internal components, or perform any soldering or circuit-board repair. Our process uses professional-grade diagnostic and recovery software to extract data from logically damaged, corrupted, or failing drives. This approach resolves the vast majority of data loss scenarios — including accidental deletion, filesystem corruption, partition damage, and failing sectors — at a fraction of the cost and turnaround time of cleanroom lab services.
If your drive requires physical repair (e.g., head replacement, platter transplant, or PCB work), we will let you know during our diagnostic evaluation so you can pursue a specialized lab if needed. Recovery success depends on the physical and logical condition of the device.
2. Best Efforts — No Guarantee
All recovery work is performed on a best-efforts basis. Provider makes no guarantee, express or implied, regarding the amount, completeness, or usability of recovered data. Data recovery success rates vary based on the type and extent of damage.
3. Limitation of Liability
Provider's total liability shall not exceed the service fee paid. Provider is not liable for any indirect, incidental, or consequential damages including but not limited to loss of data, loss of business, or loss of revenue. Client acknowledges that further damage to the device or data loss may occur during the recovery process.
4. Device Handling
Provider will handle all devices with professional care in our secure, private facility. Devices are worked on one at a time with dedicated attention. Provider is not responsible for pre-existing damage or defects not caused by Provider's handling.
5. Data Retention & Destruction
Recovered data will be retained for 30 days after delivery, then securely destroyed. If the DoD 5220.22-M Secure Wipe add-on is selected, the original device will be wiped to Department of Defense standards after successful recovery.
6. Confidentiality
Provider will not access, copy, or disclose client data except as necessary to perform the recovery service. All recovered data is treated as confidential.
7. Pricing & Payment
A $29 non-refundable diagnostic deposit is required before work begins. This covers our diagnostic evaluation and insured return shipping with tracking for your drive. If you approve the recovery results, the $29 is credited toward your total — you don't pay extra. If you decline or no data is recovered, your drive is shipped back at no additional cost — the deposit covers it. You only pay more than $29 if you approve the recovery. Customer is responsible for inbound shipping to our facility.
8. Governing Law
This agreement is governed by the laws of the State of Tennessee.
9. Acceptance
By signing below and submitting this form, the client acknowledges they have read, understood, and agree to all terms above.
